The terms that govern your use of the Hustlery website and platform.
Last updated: 16 May 2026
1. Agreement to These Terms
These Terms of Service ("Terms") govern your access to and use of the Hustlery website at hustlery.co.za and the Hustlery platform (together, the "Service"), provided by Hustlery (Pty) Ltd ("Hustlery", "we", "us"), a company registered in South Africa.
By creating an account, starting a trial, or using the Service, you agree to these Terms. If you use the Service on behalf of a business, you confirm that you are authorised to bind that business to these Terms. If you do not agree, do not use the Service.
2. About Hustlery & the Service
Hustlery is a marketing, CRM, automation and payments platform for small businesses. It lets you run ads, capture and manage leads, automate follow-ups across SMS, email and WhatsApp, take bookings, and send invoices.
The Service is delivered using established third-party software platforms, including HighLevel and Plai. We may add, change or remove features over time.
3. Eligibility & Your Account
You must be at least 18 years old and able to enter into a binding contract to use the Service.
You are responsible for the information in your account, for keeping your login details secure, and for all activity under your account. Tell us promptly if you suspect any unauthorised use.
4. Subscriptions, Billing & Refunds
The Service is offered on paid subscription plans, billed in advance on a recurring basis. Prices are shown on our Pricing page in South African Rand.
Your subscription renews automatically until you cancel. You may cancel at any time; cancellation takes effect at the end of your current billing period.
Except as required by law, fees already paid are non-refundable.
5. Acceptable Use
You agree to use the Service lawfully. You may not:
- Send spam or unlawful, deceptive, misleading or harassing messages;
- Upload or contact people whose details you obtained without permission;
- Infringe the intellectual property, privacy or other rights of anyone;
- Attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service;
- Use the Service to break any applicable law or regulation.
We may suspend or limit accounts that breach this section, to protect the Service and other users.
6. Your Content & Customer Data
You keep ownership of the content and data you put into the Service, including your contacts and leads ("Your Data"). You grant us a limited licence to host and process Your Data solely to provide the Service to you.
You are responsible for Your Data, for its accuracy, and for having a lawful basis and the necessary consent to collect and contact the people in it, in line with the Protection of Personal Information Act (POPIA) and other applicable law.
7. Messaging & Marketing Compliance
The Service lets you send SMS, email and WhatsApp messages and run advertising. You are responsible for ensuring every message and campaign complies with the law and the rules of the relevant platforms, including obtaining consent where required, honouring opt-outs, and not sending prohibited content. Misuse of messaging may result in suspension.
8. Third-Party Services
The Service relies on and integrates with third parties, including HighLevel, Plai, payment processors and messaging providers. Your use of those integrations may also be subject to their own terms. We are not responsible for third-party services, and their availability is outside our control.
9. Intellectual Property
The Hustlery name, logo, website and platform, excluding Your Data, are owned by Hustlery or its licensors and are protected by law. These Terms do not transfer any of those rights to you. You may not copy, resell, or create derivative works from the Service except as expressly permitted.
10. Service Availability & Changes
We work to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted or error-free. We may carry out maintenance, and we may change, suspend or discontinue parts of the Service.
11. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent allowed by law, we make no warranties about the Service, including as to results, performance, or fitness for a particular purpose. We do not guarantee any specific marketing outcome, lead volume, or revenue.
12. Limitation of Liability
To the maximum extent permitted by law, Hustlery will not be liable for any indirect, incidental or consequential loss, or for loss of profit, revenue or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the claim arose.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under South African law, including under the Consumer Protection Act.
13. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or where necessary to comply with the law.
On termination, your right to use the Service ends. You may request an export of Your Data within a reasonable period after termination, after which we may delete it.
14. Governing Law
These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute, subject to any rights you have under the Consumer Protection Act.
15. Changes to These Terms
We may update these Terms from time to time. The "last updated" date above shows the latest revision. Where changes are material, we will take reasonable steps to notify you. Continuing to use the Service after an update means you accept the revised Terms.
